TERMS AND CONDITIONS

Discover Mentawais or its travel partners do not assume responsibility for those inherent risks which may cause unfortunate accidents or incidents during ordinary travel conditions. Discover Mentawais will not be held responsible for injury, death, damage, loss, delay, cost, expense, or inconvenience arising from travel misfortunes beyond our control.

The captain and management  reserves the right to remove any passengers from Discover Mentawais trips that endangers the well-being and safety of the vessel, its passengers or crew, in accordance with Maritime Law.

DEPOSITS:

  1. For individual bookings, a non-refundable deposit (in Australian Dollars) of 25% of the charter fee per person is due at the time of booking.
  2. For full boat bookings a non-refundable deposit (in Australian Dollars) of 25% of the charter fee is due at the time of booking.
  3. In accepting one of our Pay Advantage payment plans, a flat $500 deposit is due at the confirmation of payment plan. A non-refundable amount of 25% of charter fee constitutes as the full non-refundable deposit (in Australian Dollars). Administration fees apply.
  4. Deposits are non-refundable.

PAYMENT:

  1. Final Payment is due at least 60 days prior to departure and is non-refundable.
  2. Final Payment on a payment plan system is due 30 days prior departure and is non-refundable.
  3. Payment may be paid by cash, payment plan, card or bank transfer.
  4. Deposits are transferrable to a third party for the same trip dates.
  5. Any form of payment constitutes acceptance of the Terms and Conditions stated on this site.
  6. Mentawai Surf Tax is a mandatory charge that goes to the local governing body of the Mentawai Region. Currently US$100 per person.

CANCELLATION POLICY:

  1. Cancellation of a trip must be made up to 60 days before your departure date (the day you are scheduled to depart Padang) or you will forfeit the full trip fee.
  2. There are no refunds or partial refunds given for early departures from a designated charter, poor surf, inclement weather or unforeseen operational issues. In addition, there are no refunds given for reasons pertaining to unstable global, national,environmental, economical or local political situations that pose a threat to the safe operations of our trips or require a trip to be cancelled.
  3. To reschedule a trip contact Discover Mentawais for a solution. Regardless of the outcome or reason, all cancellation, deposit, payment terms still apply.
  4. Discover Mentawais can reschedule or make changes to a trip if required, due to any unforeseen circumstances and will honour the rescheduled trip changes. 

TRAVEL:

  1. A current travel insurance policy, including a Medi-Vac clause is mandatory on all of our trips for your safety.
  2. Discover Mentawais and its travel partners/ associates will not be held responsible for inherent risks or situations that result in injury, death, damage, loss, delay, cost, expense, or inconvenience arising from travel misfortunes beyond their control, both when in transit and during your trip.
  3. Guests are advised to have their own cover for valuable items, such as laptop computers, cameras and surfboards.  Discover Mentawais are not responsible for the possessions of guests, including electronics and surfboards.

DOCUMENTATION:

  1. Passports must be valid for at least 6 months from the date of departure.
  2. If applicable, a valid visa is required for travel.
  3. Any official documentation required for travel is the sole responsibility of the individual. Discover Mentawais accepts no responsibility for issues entering Indonesia.

AIRLINE RELATED INFORMATION:

  1. Discover Mentawais is not responsible for airline board fees or baggage policies.
  2. Discover Mentawais does not accept any responsibility for late arrival or non-arrival of surfboards/ surfboard bags or any other luggage.
  3. Discover Mentawais does not accept any responsibility for expenses due to late arrival which requires additional transportation or expenses.
  4. Terms ‘1’ to ‘3’ also apply to transport on the Mentawai Fast Ferry.

HEALTH, INJURY & INDEMNITY:

  1. Discover Mentawais are not responsible for health problems arising from environmental factors during your stay.
  2. The charter vessel and any associated equipment has the potential to be dangerous, if mistreated or used irresponsibly.  Discover Mentawais employs qualified professionals and briefs clients extensively before departure.  Discover Mentawais can not be held responsible for any injury, indemnity or loss for the duration of your trip, due to the actions of the individual, crew or others, or due to mechanical failure.
  3. Guests are responsible for ensuring that they have appropriate cover on their travel insurance, with all appropriate extensions.  This is usually in the form of ‘extreme sports cover’ and should cover ‘live aboard on a sailing vessel’ and ‘surfing’.
  4. Guests are responsible for their own actions whilst on a Discover Mentawais trip.  The activities undertaken on our trips carry inherent risk and upon entering into this agreement guests confirm that they take sole responsibility for their actions, and any resulting damage, both physical and medical.

COVID, PANDEMIC, GLOBAL CONDITIONS:

  1. In the event of a global pandemic or geographic event, where it is financially, or physically impractical for guests more than 30 days from the date of departure to complete their trip, Discover Mentawais will give the option to rebook new dates at no extra cost, regardless of whether the full balance has been settled.  Priority on dates will be given to bookings on which the full balance has been settled and only available dates will be offered.
  2. Discover Mentawais will attempt to accommodate bookings within 30 days of departure, but there is no obligation for them to do so. 

EMERGENCY:

  1. In the event of any emergency situation, the captain of the vessel is the authority in charge and has final say on the course of events.  If the captain is unable to complete his duties due to illness, or injury then this responsibility is handed down to the first mate. 
  2. Before departure, guests will be extensively briefed on the vessels safety procedures and location of any relevant equipment, as well as how to operate it.  It is the responsibility of the guests to attend and listen.  In the event of an emergency, no equipment is to be deployed without the authority of the captain. 

RESPONSIBILITY:

Discover Mentawais will use all due care for the provision of its services and activities provided to guests. Guests participate in activities and use services at their own risk. No liability or responsibility is accepted by Discover Mentawais for any injury, illness, damage, loss, accident, expense, or any other claim arising from involvement in any activities or provision of any services howsoever suffered, even in circumstances where staff of Discover Mentawais may have negligently breached any duty of care that it or they may owe or have owed in connection with such activities, conduct, supervision, or the provision of services. Discover Mentawais will no longer be liable for direct or indirect losses, arising from any such injury, illness, damage, loss accident, or expense including consequential loss or economic loss, however caused.
